Terms of Service

The short version
  • ClaimCam gives you evidence for damage claims. It doesn't decide claims or guarantee how a dispute turns out.
  • Paid plans are monthly and you can cancel any time from "Manage billing".
  • You're responsible for how you use your customers' photos; we handle them only to run the service.

1. The agreement

These terms are between you and RJ Macarthy, a sole trader in the United Kingdom who runs ClaimCam ("we", "us"). By creating an account or using ClaimCam, you agree to them and to our Privacy Policy. ClaimCam is for businesses: you confirm you're using it for a business, are 18 or over, and can accept these terms for that business.

2. What ClaimCam does

ClaimCam makes claim links you send to your customers. The customer takes live photos of an item with a one-time code, and you get an evidence page showing the photos, when they were taken, and capture details such as the country, device and photo fingerprints. If it's turned on, an AI review adds an automated opinion of the photos.

ClaimCam is a tool for gathering evidence, not a decision. Checks and AI reviews can be wrong in either direction, and a "flag" doesn't prove fraud. You make your own decisions about refunds, replacements and disputes, and you should treat customers fairly and lawfully. Nothing on ClaimCam is legal advice.

3. Your account

Keep your sign-in details safe and don't share your account. You're responsible for activity under it. Use an email address you control: that's how we sign you in and contact you. Tell us straight away through the "Need help?" form if you think someone else has access.

You must not use ClaimCam to:

"Unlimited" covers normal use by a single business. If use is abusive or puts the service at risk, we'll contact you first where we reasonably can.

6. Your customers' data (data processing)

For the photos and capture details your customers send, you are the controller and we are your processor, under UK GDPR Article 28. You confirm you have a lawful basis for asking customers to send photos, and that your own privacy notice covers using ClaimCam. The claim page tells customers the photos go to you to handle their claim, and links to our Privacy Policy. We will:

7. Content and intellectual property

You keep ownership of your store name, logo and claim content. You give us permission to use them only to run ClaimCam for you. We own ClaimCam itself: the software, design and brand. Feedback you send us can be used to improve the service without any obligation to you.

8. Availability and changes

We work to keep ClaimCam running and secure, but it's provided "as is" without a guarantee of uninterrupted availability. We may change or improve features. If we ever close ClaimCam, we'll give at least 30 days' notice and refund any prepaid period that hasn't been used.

9. Liability

Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud. Otherwise:

You're responsible for, and will cover our reasonable costs from, claims arising from your breach of section 5 or 6.

10. Ending the agreement

You can stop using ClaimCam at any time. Cancel your subscription in "Manage billing" and ask us through the "Need help?" form to delete your account. We may suspend or close accounts that seriously or repeatedly break these terms. Where it's practical, we'll warn you first and give you a chance to fix the problem. When an account closes, sections 6, 7, 9 and 11 continue to apply.

11. General

We may update these terms. For significant changes, we'll email you at least 30 days before they apply; if you keep using ClaimCam after that, the new terms apply. These terms are governed by the law of England and Wales, and its courts have jurisdiction. If part of these terms can't be enforced, the rest still applies.
